JobJitsu

Terms and Conditions (T&C)

Effective: August 2026

This is the US English translation of the German "Allgemeine Geschäftsbedingungen".
In case of discrepancies, the German version shall prevail.

§ 1 Scope of Application

  1. These Terms and Conditions ("T&C") govern all contracts between Thomas Gießel, operating under the name "JobJitsu" (hereinafter "JobJitsu")
    and customers of the platform.

  2. The services are offered exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). Consumers are excluded.

  3. Deviating or supplementary terms of the customer do not become part of the contract unless JobJitsu expressly agrees to their application in text form.

§ 2 Subject Matter of the Contract

  1. JobJitsu operates a digital platform for publishing job advertisements and for the technical receipt and forwarding of applications.

  2. JobJitsu provides purely technical services and is in particular:

    • not an employer,
    • not a recruitment agency,
    • not a personnel consultancy,
    • not involved in hiring decisions.
  3. The customer is solely responsible for:

    • the content of job advertisements,
    • the recruitment process,
    • compliance with applicable laws.

§ 3 Registration and Conclusion of Contract

  1. Use of the platform requires registration of a customer account.

  2. The customer must provide complete and truthful information.

  3. The contract is concluded upon activation of the account by JobJitsu.

  4. JobJitsu may refuse registrations without stating reasons.

  5. Access credentials must be kept confidential.

  6. The customer may invite additional authorized users to the customer account within the scope of the selected plan; the maximum number of user accounts follows from the service overview published on the platform. The customer shall ensure that all authorized users comply with these Terms and Conditions and the Terms of Use. Actions of authorized users shall be attributed to the customer.

§ 4 Services and Tariffs

  1. JobJitsu offers a free plan ("Free") and paid plans ("Pro").

  2. The "Pro" plan may be subscribed to on a monthly or annual basis.

  3. The scope of services depends on the selected plan.

  4. JobJitsu may further develop features provided that essential core obligations are not restricted.

§ 5 Prices and Payment Terms

  1. The applicable prices are those set out in the price overview published on the platform.

  2. All prices are exclusive of the applicable statutory value-added tax. The applicable VAT treatment shall be determined in accordance with the relevant statutory provisions and the information provided by the customer during the checkout process.

  3. Paid services are payable in advance.

  4. Payments are processed via an external payment provider.

  5. In case of late payment, statutory default interest may be charged.

  6. The customer shall ensure that sufficient funds are available for the payment method used. If the customer initiates a chargeback, direct-debit return or payment reversal (in particular a credit-card chargeback or a buyer-protection claim) without justified cause, this constitutes a breach of the customer's payment obligation. JobJitsu's payment claim remains unaffected in such cases.

  7. If the customer is responsible for an unjustified chargeback, the customer shall reimburse JobJitsu for the resulting costs, in particular the chargeback and processing fees charged by the payment provider. The customer reserves the right to prove that no damage or a lower amount of damage was incurred.

  8. The customer may set off only claims that are undisputed or have been finally adjudicated. The customer may exercise a right of retention only insofar as the counterclaim is based on the same contractual relationship.

§ 6 Booking and Performance of Job Advertisements (One-off Service)

  1. The booking of a job advertisement (performance recruiting campaign) is a one-off service subject to separate remuneration. It is independent of the selected plan ("Free" or "Pro").

  2. By booking and paying, the customer expressly requests JobJitsu to begin performing the service immediately. JobJitsu begins setting up the advertising campaign without undue delay after payment confirmation. The job advertisement is activated as soon as the campaign is delivering; this requires approval by the advertising provider. No particular time of activation is promised.

  3. The service consists of the technical provision and delivery of the job advertisement as part of an advertising campaign. No particular outcome – in particular a specific number, quality or suitability of applications, or the conclusion of an employment relationship – is owed.

  4. The service is deemed rendered upon the start of the advertising campaign. The start of the advertising campaign is the beginning of its delivery; at that point the job advertisement is activated. The fee is earned upon the start of the campaign and payable in full; this applies irrespective of the further course or outcome of the campaign.

  5. Until the start of the campaign, the customer may cancel the booking in text form; the time the cancellation is received is decisive. In that case, JobJitsu refunds the fee in full. After the start of the campaign, cancellation is excluded and there is no claim to a refund of the fee. Statutory rights of the customer in the event that JobJitsu fails to render the service, or fails to render it in conformity with the contract, for reasons for which JobJitsu is responsible remain unaffected.

§ 7 Term and Termination of Subscriptions

  1. "Pro (Monthly)" runs for one month and renews automatically unless canceled by the last day of the current billing period.

  2. "Pro (Annual)" runs for twelve months and renews automatically unless canceled by the last day of the contractual term.

  3. No notice period applies.

  4. Cancellations take effect at the end of the current billing period.

  5. Fees already paid are not refunded pro rata.

  6. Upon termination, the account is downgraded to the "Free" plan.

§ 8 Late Payment and Downgrade of Subscriptions

  1. If the payment attempts made by the payment provider remain unsuccessful, JobJitsu is entitled to terminate the subscription with immediate effect. Upon termination, the customer account is downgraded to the "Free" plan.

  2. Paragraph 1 applies accordingly where a payment already executed is reversed as a result of a chargeback, direct-debit return or payment reversal initiated by the customer (§ 5 para. 6).

  3. Pro-specific functions will no longer be available.

  4. No data is deleted as part of the downgrade. Content already present – in particular internal notes – remains readable; creating, editing and deleting such content requires an active Pro plan. Additional user accounts remain in place; access for users other than the account owner requires an active Pro plan and ends when that plan ends.

  5. Existing job advertisements remain unaffected.

§ 9 Termination of Customer Account

  1. The customer may terminate the entire account at any time.

  2. Access remains available after the termination is received until the data is deleted, for no longer than 30 days. Until then, the customer can export their data themselves within the scope of their plan; beyond that, JobJitsu provides the data on request.

  3. Upon termination of the customer account, a running subscription is canceled with effect from the end of the current billing period, unless the customer has already canceled it. Upon deletion of the customer account, access ends even if that billing period is still running. Fees already paid are not refunded pro rata.

  4. Personal data that JobJitsu processes on the customer's behalf is returned or deleted in accordance with the DPA (§ 13). Contract and invoice data is retained for the duration of the statutory retention periods.

§ 10 Suspension and Extraordinary Termination

  1. JobJitsu may suspend accounts in case of:

    • breach of these T&C,
    • unlawful content,
    • misuse of the platform,
    • payment arrears.
  2. As a rule, JobJitsu will ask the customer to remedy the breach within a reasonable period before suspending the account. In serious cases, an account may be suspended without a prior request.

  3. Suspension withdraws access to the platform. Job advertisements already booked whose advertising campaign has started are not affected by the suspension and continue to be delivered in accordance with § 6. The claim to the fee likewise remains unaffected.

  4. The suspension is lifted once the reason for it no longer applies.

  5. In serious cases, extraordinary termination is permitted.

§ 11 Customer Obligations

  1. The customer must use the platform lawfully.

  2. The customer is responsible for all content submitted by them.

  3. The customer is responsible for activities under the account.

  4. The customer must not insult, threaten, discriminate against or harass JobJitsu or the persons acting for JobJitsu. This applies irrespective of the channel of communication.

§ 12 Responsibility for Content

  1. The content of the job advertisement is determined solely by the customer and published on the customer's behalf.

  2. JobJitsu does not review content in advance and makes no content changes of its own. Any notes or suggestions for improvement offered to the customer are non-binding; they become part of the job advertisement only if the customer adopts them individually. Responsibility for the content remains with the customer in all cases.

  3. Unlawful content may be removed without notice.

  4. The advertising material of the campaign – in particular the ad copy and imagery on the advertising providers' platforms – is created by JobJitsu on the basis of the job advertisement. JobJitsu is responsible for its design; the details of the position originate from the customer's job advertisement.

  5. JobJitsu receives notices of unlawful content at dsa@jobjitsu.de (Art. 16 of Regulation (EU) 2022/2065 on digital services). Notices, and measures taken because content is unlawful or violates these T&C or the Terms of Use, are decided by humans; no automated means are used for this. Possible measures are the removal or blocking of a job advertisement, including its advertising campaign, and the suspension of the account under § 10. If JobJitsu takes such a measure, JobJitsu informs the customer in text form no later than when the measure takes effect, stating the type and duration of the measure, the facts relied on, whether it is based on a notice, and the legal provision or contractual term infringed. The customer may object to the decision by email to dsa@jobjitsu.de; recourse to the courts remains unaffected.

§ 13 Liability

  1. JobJitsu has unlimited liability for intent, gross negligence, injury to life, body or health, and under product liability law.

  2. In cases of slight negligence of essential contractual obligations, liability is limited to foreseeable typical damage. Essential contractual obligations are those whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the contracting party may regularly rely.

  3. Otherwise, liability is excluded.

  4. No liability is assumed for hiring success or recruitment outcomes.

  5. The limitations in paragraphs 2 to 4 do not apply to the cases set out in paragraph 1.

§ 14 Indemnification

The customer shall indemnify JobJitsu against third-party claims resulting from unlawful content or misuse. This does not apply where a claim is based on the design of advertising material created by JobJitsu.

§ 15 Data Protection

  1. Personal data is processed in accordance with the Privacy Policy.

  2. Where the customer engages JobJitsu to process personal data within the meaning of Art. 28 GDPR, the Data Processing Agreement (DPA), incorporated as an integral part of these T&C, shall apply and form part of the contractual relationship.

§ 16 Price Adjustments

  1. JobJitsu may adjust prices for future contractual periods.

  2. Price changes will be announced at least six weeks in advance. The announcement refers to the right to object under paragraph 3 and separately highlights that a failure to object is deemed acceptance.

  3. If the customer does not object by the date the change takes effect, the change is deemed accepted.

  4. In case of objection, the subscription ends at the end of the current period.

§ 17 Amendments to these T&C

  1. JobJitsu may amend these T&C, including the Terms of Use and the Data Processing Agreement incorporated as integral parts, with effect for the future, where the amendment is necessary due to

    • a change in legislation or case law, or an official or judicial order,
    • the introduction of new platform features or changes to existing ones,
    • technical or security-related adjustments, or
    • a change in the service providers engaged to deliver the service.
  2. The primary contractual obligations and the agreed prices may not be amended under paragraph 1. Price changes are governed by § 16, the engagement of sub-processors by § 8 DPA.

  3. Amendments are announced to the customer in text form at least six weeks before they take effect. The announcement states the amendment and the date it takes effect, refers to the right to object under paragraph 4, and separately highlights that a failure to object is deemed acceptance.

  4. The customer may object to the amendment in text form until the date it takes effect. If the customer does not object, the amendment is deemed accepted.

  5. In case of objection, either party may terminate the contract with effect from the end of the current contractual period, or, for contracts without a billing period, from the date the amendment takes effect. Until termination takes effect, the previous terms continue to apply to the customer, unless the amendment is required by law or by an official order.

§ 18 Availability

  1. JobJitsu strives for high availability.

  2. Continuous and uninterrupted availability is not guaranteed.

  3. Interruptions may occur due to maintenance, technical issues or force majeure.

§ 19 Final Provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

  2. Place of jurisdiction is Berlin, where legally permissible.

  3. Should any provision be invalid, the remainder remains unaffected.
